On January 31, 2024, the City of Markham enacted By-law 2024-19, known as the Comprehensive Zoning By-law, under Section 34 of the Ontario Planning Act. Background
The City of Markham has historically been governed by 42 separate zoning by-laws, many of which were enacted between the 1950s and 1980s. Due to their age, several of these by-laws, especially those pertaining to areas developed before 1995, are not available in digital format and are not accessible online.
Recognizing the need for modernization and consolidation, the City undertook a comprehensive review of its zoning framework. This effort culminated in the enactment of By-law 2024-19 on January 31, 2024, which aims to unify and update the existing zoning regulations.
Key Objectives of By-law 2024-19:
Alignment with Current Planning Policies:
The new by-law ensures consistency with Markham's 2014 Official Plan, the Regional Municipality of York’s Official Plan, provincial plans, and policies, as well as the Ontario Planning Act.
Modernization of Zoning Standards:
It addresses outdated provisions and inconsistencies in definitions, permitted uses, and development standards that had accumulated over time.
Streamlined Development Process:

OLT Implementation and Transitional Provisions:
Following its enactment, By-law 2024-19 was appealed to the Ontario Land Tribunal (OLT). On September 19, 2024, the OLT approved the by-law on a city-wide basis, with exceptions for lands associated with remaining site-specific appeals. The OLT ruled that the by-law is deemed to have come into force retroactively on January 31, 2024.
